Controller and scope
The controller of this website is Cristian Rodriguez, creator of NearbyFlights, a free personal project with no economic activity. You can contact him at [email protected]. The website server is located in Munich, Germany.
This policy covers browsing this website, email enquiries and the information published in its leaderboard. Visiting the website does not install the Garmin app, register a watch or enable leaderboard participation.
Data when you visit
To deliver pages and respond to requests, the infrastructure receives connection data, such as your IP address, access date and time, requested path and browser information. Technical logs may be processed to maintain the service and investigate faults or abuse.
The website does not request access to your browser's GPS and does not need your location to display the leaderboard. It does not embed browser analytics or advertising tools. It uses a first-party cookie to remember your language, described on the cookies page.
If you email the contact address, your email address, message and information needed to handle the enquiry will be processed. Do not send passwords or private watch credentials.
Public leaderboard information
The leaderboard receives profiles and results from the NearbyFlights service. Data is associated with an identifier and an alias: it is pseudonymised, not necessarily anonymous. Avoid putting your real name or other personal information in your alias if you do not want it to be public.
The leaderboard does not publish GPS coordinates, travel histories, watch credentials or the exact time of each sighting. The following information can be viewed:
- Profile alias, public identifier, rank and country.
- Leaderboard points.
- Unique aircraft and unique model totals, for a selected month or all time.
- Country totals and the number of explorers.
Purposes and legal bases
Connection data is used to deliver the website, keep it available and protect it against faults and abuse. The basis is the legitimate interest in operating a secure, functional service under Article 6(1)(f) GDPR.
Profiles and results are displayed to provide a recreational leaderboard with limited public information, respecting each profile's participation settings. This is based on the legitimate interest in providing this community feature; you can object, hide your profile through the app settings or request erasure by email.
Contact messages are used to respond to the enquiry received, based on the legitimate interest in handling enquiries. Requests to exercise data protection rights are handled to comply with applicable legal obligations under Article 6(1)(c) GDPR.
Website data is not used for advertising, selling profiles or decisions with legal or similarly significant effects. Reading this policy does not constitute consent to additional processing.
Access and publication
The controller and those maintaining the technical infrastructure may access data needed to operate and protect the service. Contact messages and technical logs are not part of the public leaderboard.
Any visitor can view visible profiles and leaderboard statistics. Because this information is public, other people may copy or retain it. Hiding a profile on NearbyFlights does not remove copies that others have made independently.
Retention and controls
The website fetches the leaderboard and may cache responses for up to 30 seconds. The cache is separate from the sighting history: the service retains profiles and results to maintain monthly and all-time rankings while the profile exists or until an erasure request is fulfilled, unless retention is legally necessary.
You can change your alias, country and participation in the app settings in Garmin Connect. The version with the leaderboard participates by default on compatible watches. Turning it off hides the profile once the watch syncs the setting, but does not erase earlier sightings. The website has no account deletion interface; you can request erasure at [email protected].
Messages are kept while the enquiry is handled and, where necessary, to address related liabilities or claims. Technical logs are retained for the time needed to investigate incidents and protect the service.
Your rights and how to contact us
You can request access, rectification, erasure, restriction, objection and, where applicable, portability by emailing [email protected]. Explain your request and include the alias or public identifier needed to locate your profile. Additional information will only be requested where needed to verify that you are entitled to make the request.
A response will normally be provided within one month. If the complexity or number of requests requires a legally permitted extension, you will be informed within that first month. You can also lodge a complaint with the Spanish Data Protection Agency.
